MEMBERSHIP IN THE AIR NATIONAL GUARD IS REQUIRED: This is an Excepted Service position that requires membership in the Idaho Air National Guard as a condition of employment. Selectee will be required to wear the military uniform. Acceptance of an Excepted Service position constitutes concurrence with these requirements as a condition of employment. Loss of military membership will result in immediate loss of your full-time military technician position.

DUTIES:
MAJOR DUTIES: (Detailed duties are on the Position Description)

Major duties include but are not restricted to:


The primary purpose

of the position is to serve as the sole full-time professional legal advisor, providing

consultation, collaboration, support,

guidance, and subject matter expertise

(SME) to the Wing Commander. Also serves as the full-time

legal advisor to Geographically Separated Unit (GSU) commanders

and staff. Provides SME authoritative advisory, consultation, and collaboration

in the areas of ethics, medical

and physical evaluation, labor, domestic operations and administrative law.


MAJOR DUTIES:


ADMINISTRATIVE LAW: Advises

Commander and staff on interpretation of federal

statutes and regulations, ensures

that legal advice, consultation, and collaboration is furnished

in a timely manner.


LABOR AND EMPLOYMENT LAW: Provides

advisory, guidance, consultation, and collaboration to Commander, staff, and supervisors.


ETHICS: As the

SME in Government Ethics, provides

training to all unit members, staff and

personnel on matters such as 1) Financial disclosure programs and reviews; 2) Ethics counselor program

training, advice and assistance; 3) Post-government employment program

advice and assistance; and 4)

Gift acceptance programs,

including gifts of travel,

gifts to the command

and service member.


LEGAL ASSISTANCE: Provides legal assistance on

a non-interference basis to members of the ANG, spouses of members, and family members as authorized by ANGI 51-504,

AFI 51-504 (when applicable), CNGBI, NGR, and other AF/JA guidance and, as resources and expertise permit, legal assistance may also be provided to Active Component

members, other Reserve

Component m


POLICY

SETTING: Formulates Wing legal

policy and its execution; legal representation; legal

initiatives; constitutional, civil, criminal, labor law; a full

spectrum of expert legal advice

to Wing leaders.


MILITARY

JUSTICE: Prepares and renders legal advice and opinions to commanders and senior staff regarding

military justice options.


DISABILITY

EVALUATION SYSTEM (DES): Provides legal advice, legal briefings, and counsel to

Wing leadership on the DES

process.


DOMESTIC

OPERATIONS: Provides professional legal

advice and opinions on issues

arising from federal laws and

regulations and their application to the National

Guard or concerning the federal

mission of the National Guard, including homeland defense and security, emergency response, and


QUALIFICATIONS REQUIRED:
GENERAL EXPERIENCE:


Professional

legal positions involved in preparing cases for trial and/or the trial of

cases before a court or an administrative body or persons having quasi-judicial power; rendering legal advice and services

with respect to questions, regulations, practices, or other matters falling within the purview of a Federal

Government agency.


EDUCATION REQUIREMENTS:


Must

have a law degree (LLB or J.D) from

a law school accredited by the American

Bar Association and be an

active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico Bar.


SPECIALIZED EXPERIENCE:


Within your application package, you must explain how you gained the specialized experience required for this position. Applicants applying at the GS 12 level must have


at

least 36 months experience, education or training in the preparation of cases

for trial and/or tries cases before a court

or an administrative body of

persons having quasi-judicial power, the rendering of legal advise and services with respect to questions, regulations, practices or other matters

falling within the purview of a Federal Government, the preparation of interpretive and administrative orders, rules, or regulations to give effect to provisions of governing statutes or other

law requirements. Skill

in analyzing, discussing and providing

oral and written counsel on complex legal arguments in a representative capacity in

a manner that aids the recipient in understanding the issues, options, and recommended courses of action.

Payments of Selected Reserve reenlistment bonuses authorized in section 308b of title 37, United States Code, to Military Technicians (Dual Status) who become eligible for reenlistment while serving on active duty in Iraq, Afghanistan or Kuwait in support of Operation Enduring Freedom or Operation Iraqi Freedom or Operation New Dawn (in theater) are excluded from repayment. Acceptance of any military technician position may affect your incentive bonus. Check with your incentives manager to see if this applies to the incentive you received.
